1. Acceptance of Terms

You may use the Service only if you agree to these Terms.

By affirmatively selecting the checkbox stating that you have read and agree to these Terms and submitting your acceptance, you agree to be legally bound by them.

If you do not agree, you may not access or use the Service.

These Terms include the Treat Purchase Terms where applicable, and any other policies expressly incorporated into these Terms.

2. Eligibility and Minors

You must have the legal capacity to enter into these Terms.

If you are under 18 years of age, your parent or legal guardian must review and agree to these Terms on your behalf to the extent required by applicable law.

Real-money transactions for Treats or other paid digital content may be made only by a person who is at least 18 years old or by a parent or legal guardian who is legally authorized to make the transaction.

The Service is not directed to children under 13. You must be at least 13 years old to create or use a Cat Champions account.

If you are under the age of majority where you live, you may use the Service only with the permission of your parent or legal guardian.

3. Accounts

Your account is a means of obtaining access to the Service. An account itself is not personal property and is not sold to you.

You may not sell, purchase, rent, lend, share, transfer, sublicense, or commercially exploit an account except where Cat Champions expressly permits a particular transfer in writing.

You are responsible for maintaining the confidentiality of your credentials and for activity occurring through your account to the extent permitted by applicable law.

You must not knowingly provide another person with access to your account.

Cat Champions may require reasonable verification of account ownership, identity, payment information, or other account information when necessary for security, fraud prevention, enforcement, support, or compliance with law.

4. Limited License to Use Cat Champions

Subject to your continued compliance with these Terms, Cat Champions grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for personal, noncommercial entertainment.

This is a license to use the Service. It is not a sale or transfer of ownership in the Service or its virtual content.

The license automatically ends when your account is permanently terminated or when you otherwise lose the right to use the Service under these Terms.

5. Virtual Content Is Licensed, Not Owned

“Virtual Content” includes, without limitation, characters or cats, Treats, catnip, items, equipment, skills, statistics, levels, experience, achievements, trophies, rankings, leaderboard positions, titles, rewards, currencies, unlocks, packages, bonuses, progress, and any other data, entitlement, or content existing within Cat Champions.

Except for intellectual-property rights you may separately hold in original content you create, Virtual Content is part of the Service and is licensed to you rather than sold to you.

You do not acquire an unrestricted ownership interest, property interest, cash value, security interest, or other real-world proprietary right in Virtual Content merely because you earned, received, or paid money in connection with it.

Virtual Content exists only within Cat Champions and may be used only as permitted by Cat Champions.

Unless expressly permitted by Cat Champions, Virtual Content may not be sold, purchased, exchanged, transferred, pledged, rented, or traded for real money, cryptocurrency, goods, services, or anything of value outside the Service.

Virtual Content has no guaranteed monetary value and cannot be redeemed or cashed out for money from Cat Champions.

6. Game Changes and Balancing

Cat Champions is an evolving online game.

We may add, remove, rebalance, modify, replace, limit, or discontinue game mechanics, skills, items, rewards, opponents, jobs, progression systems, drop rates, prices denominated in virtual currency, statistics, combat mechanics, leaderboards, events, features, or other portions of the Service.

A particular mechanic, item, skill, statistic, strategy, feature, or relative competitive advantage is not guaranteed to remain unchanged.

Changes to gameplay do not create an entitlement to compensation or a refund except where applicable law requires otherwise.

We may also correct errors in game data, balances, rewards, progression, transactions, or Virtual Content.

7. Fair Play and Prohibited Automation

Cat Champions is intended to be played through human input using the interfaces and methods made available by Cat Champions.

Unless Cat Champions expressly approves otherwise, you may not use automation or assisted-input methods that provide an unintended input, timing, repetition, concurrency, or execution advantage.

Prohibited methods include, without limitation, bots, macros, auto-clickers, scripts, turbos, input recorders or replayers, automated key presses, synthetic input, repeated-input functions, hardware or software configured to generate multiple game actions from a single physical action, scroll-wheel input used to generate repeated game actions, modified game code, automated HTTP requests, request replay, browser or client manipulation intended to automate gameplay, and comparable techniques.

One physical user action should ordinarily result in one corresponding intended game action.

A remapping, accessibility tool, or other input method may still be prohibited if it automates gameplay, bypasses a game mechanic, defeats an attention or verification mechanism, produces additional actions, interferes with anti-cheat systems, or otherwise creates an unintended advantage.

Players who require an accommodation may contact Staff before using a method that would otherwise violate this section. Approval must be obtained from Cat Champions and may be subject to reasonable conditions.

8. Exploits, Client Manipulation, and Circumvention

You may not intentionally exploit any bug, vulnerability, unintended interaction, request, client or server behavior, authentication mechanism, game-state inconsistency, or other technical condition to obtain an advantage or result Cat Champions did not intend.

You may not modify, forge, replay, automate, or manipulate requests to Cat Champions in order to bypass ordinary gameplay.

You may not circumvent rate limits, attention checks, anti-cheat measures, access controls, account restrictions, bans, cooldowns, payment restrictions, or other technical or administrative controls.

Discovering a vulnerability does not authorize exploiting it. Vulnerabilities should be reported privately to Cat Champions Staff.

9. Ban and Restriction Evasion

You may not evade or assist another person in evading a warning, restriction, suspension, termination, or other enforcement action.

This includes using another account, creating an alternate account, using another person's account, changing network or device information, or using VPNs, proxies, anonymization services, or other mechanisms for the purpose of circumventing an enforcement action.

Cat Champions may apply reasonable enforcement measures to related accounts, characters, sessions, or devices when evidence indicates that they are being used by the same person or are being used to evade enforcement.

10. Community and Communications

Players may engage in ordinary in-game rivalry, competitive banter, and playful smack talk.

Harassment, credible threats, stalking, doxxing, hate speech, discriminatory slurs, targeted personal abuse, impersonation intended to deceive, extortion, disclosure of another person's private information without authorization, or conduct directed at the real-life person behind the player rather than ordinary in-game competition is prohibited.

Cat Champions Staff and moderators reserve the right to remove, restrict, or moderate messages, chat content, or other communications that they reasonably determine are disrespectful, disruptive, inflammatory, irrelevant to the Service, or likely to cause unnecessary conflict or disruption within the community. This may include, without limitation, discussions concerning real-world politics, religion, geopolitical disputes, or other controversial or divisive subjects. Staff may ask players to discontinue a topic even where the discussion would not otherwise violate these Terms.

Do not distribute cheats, exploits, automation, circumvention methods, or instructions for abusing the Service except when privately reporting a vulnerability to Staff.

Do not intentionally encourage another person to violate these Terms.

Do not falsely impersonate Cat Champions Staff or falsely represent an official Staff decision.

You may not use Cat Champions communications to engage in scams or fraud, distribute malware or phishing links, send abusive or disruptive spam, solicit unlawful activity, or distribute sexually explicit or otherwise unlawful content.

In-game chats, direct messages, and other communications may be logged and may be reviewed by authorized Cat Champions personnel for moderation, security, fraud prevention, support, enforcement, and legal compliance as described in the Privacy Policy. You should not treat in-game communications as confidential communications with Cat Champions.

Spam, flooding, unsolicited advertising or promotion, and repeated disruptive messaging are prohibited. Players must comply with reasonable Staff or moderator instructions concerning use of the Service, community conduct, and communications.

11. Real-Money Trading and Commercial Use

Unless Cat Champions expressly provides a mechanism permitting it, you may not sell or purchase accounts, Virtual Content, services, gameplay actions, leveling services, currency, items, or other Cat Champions benefits for real-world consideration.

You may not operate the Service commercially, farm Virtual Content for sale, or use Cat Champions as part of an unauthorized commercial service.

12. Investigations and Anti-Cheat Enforcement

Cat Champions may use account records, gameplay and technical telemetry, session and transaction records, reports, security information, statistical analysis, and other reasonably available evidence to investigate suspected violations.

The fact that a particular detection method is not described publicly does not make prohibited conduct permissible.

To protect the effectiveness and security of anti-cheat and fraud-prevention systems, Cat Champions is not required to disclose detection thresholds, source code, investigative techniques, internal scoring methods, security controls, or other information that could facilitate circumvention, except where disclosure is required by law.

Staff may consider the totality of available evidence rather than any single indicator.

13. Enforcement and Sanctions

Cat Champions may take enforcement action when it reasonably determines that a player has violated these Terms, abused the Service, obtained illegitimate benefits, engaged in fraud, threatened the security or operation of the Service, evaded prior enforcement, materially disrupted the community, or created a significant risk to Cat Champions or its users.

Enforcement may include warnings; removal of content; action limits or cooldowns; restriction or disabling of fights, Run, jobs, chat, direct messages, trading, leaderboards, purchases, social features, or other individual features; removal from competitive systems; reversal or rollback of illegitimate progress; correction of statistics; removal of improperly obtained Virtual Content; reversal of erroneous credits or rewards; temporary suspension; permanent restrictions; or termination of the account and its license to access the Service.

Cat Champions may use a targeted restriction instead of terminating an entire account.

Serious, repeated, deliberate, fraudulent, abusive, security-related, or evasive conduct may result in immediate suspension or termination without a prior warning.

There is no entitlement to progressive discipline, a warning, or a particular penalty before stronger enforcement is imposed, except where required by applicable law.

Where Cat Champions offers an internal appeal or review, the availability and procedure for that review may be determined by Cat Champions. Unless otherwise stated, an internal enforcement decision is final after any offered review has concluded.

14. Rollbacks and Illegitimate Gains

If progress, currency, rewards, items, achievements, statistics, or other Virtual Content were obtained through cheating, exploitation, automation, abuse, fraud, an error, or another violation of these Terms, Cat Champions may remove or correct the affected gains.

A rollback may include reasonably related gains when separating legitimate and illegitimate progress is impracticable.

Cat Champions is not obligated to preserve benefits resulting from an error merely because the error remained available for a period of time.

15. Paid Virtual Content Does Not Exempt an Account From Enforcement

Making a real-money payment to Cat Champions does not purchase ownership of an account, guarantee continued access to the Service, or exempt the player from these Terms.

Paid and unpaid players are subject to the same enforcement authority.

If an account is restricted, suspended, or terminated because of a violation of these Terms, fraud, payment abuse, security abuse, or other misconduct, the player may lose access to unused Virtual Content, including Virtual Content obtained in connection with a real-money transaction.

Except where required by applicable law or expressly approved by Cat Champions, the loss of access resulting from enforcement for a Terms violation does not create a right to compensation or a refund for unused Virtual Content.

16. Payments and Treats

Real-money transactions involving Treats are additionally governed by the Treat Purchase Terms presented during checkout.

Treats and other paid digital content remain Virtual Content under these Terms.

Any transaction processed by a third-party payment provider is also subject to that provider's applicable rules. Nothing in these Terms eliminates any consumer right that cannot lawfully be waived.

17. Payment Reversals, Fraud, and Chargebacks

You may use legitimate rights provided by applicable law and your payment provider.

However, intentionally initiating a false, fraudulent, duplicative, or abusive payment dispute, using an unauthorized payment method, or misrepresenting delivery or use of Virtual Content may violate these Terms.

If a payment is reversed, refunded, charged back, cancelled, found unauthorized, or otherwise not ultimately received by Cat Champions, Cat Champions may revoke the Virtual Content associated with that payment and may correct resulting game balances or benefits.

If the associated Virtual Content has already been consumed or used, Cat Champions may place reasonable restrictions on the affected account while the transaction and resulting game state are reviewed.

This section does not restrict any non-waivable right to dispute an unauthorized or legally disputable transaction.

18. Service Availability

Cat Champions is an online service and may experience maintenance, outages, errors, attacks, hardware failures, software defects, network failures, data loss, or other interruptions.

We may temporarily restrict access to some or all of the Service for maintenance, security, updates, emergencies, investigations, or operational reasons.

Except where applicable law provides otherwise, Cat Champions does not guarantee continuous availability, uninterrupted access, preservation of any particular feature, or permanent operation of the Service.

19. Intellectual Property

Cat Champions and its software, artwork, graphics, design, game mechanics as protected by applicable law, text, logos, code, databases, audiovisual content, and other proprietary material are owned by or licensed to Cat Champions and are protected by applicable intellectual-property laws.

Except for the limited license expressly granted under these Terms, no rights in Cat Champions intellectual property are transferred to you.

You may not copy, reproduce, reverse engineer, distribute, sell, sublicense, scrape, or create unauthorized derivative works from protected portions of the Service except to the extent applicable law expressly permits notwithstanding this restriction.

20. User Content

You retain any ownership rights applicable to original content that you lawfully create and submit to the Service.

By submitting content to portions of Cat Champions intended for other users to see, you grant Cat Champions a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, and technically modify that content as reasonably necessary to operate, moderate, secure, promote, and provide the Service.

You may submit only User Content, including profile or avatar images, that you own or have the necessary rights or permission to use.

Cat Champions may remove or restrict access to material that it reasonably believes infringes another person's intellectual-property rights. Copyright owners or their authorized representatives may report suspected copyright infringement to support@catchampions.com.

Accounts that repeatedly submit infringing material may be restricted or terminated.

Cat Champions may remove, restrict, or moderate User Content as permitted by these Terms or when reasonably necessary to operate, secure, or protect the Service or its community.

If you voluntarily submit ideas, suggestions, feedback, or feature proposals regarding Cat Champions, you grant Cat Champions permission to use and develop from that feedback without restriction or compensation to you. This does not transfer ownership of unrelated original works you create.

21. Privacy

Cat Champions' collection and handling of personal information is governed by the Cat Champions Privacy Policy.

Use of the Service may involve collection of information reasonably necessary for account operation, security, anti-cheat systems, fraud prevention, payment processing, moderation, support, legal compliance, and operation of the Service, as more specifically described in the Privacy Policy.

22. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

CAT CHAMPIONS DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

NOTHING IN THIS SECTION DISCLAIMS A WARRANTY OR CONSUMER RIGHT THAT APPLICABLE LAW DOES NOT PERMIT CAT CHAMPIONS TO DISCLAIM.

23. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAT CHAMPIONS AND ITS OWNER, OPERATOR, PERSONNEL, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF GAME PROGRESS, VIRTUAL CONTENT, DATA, PROFITS, OPPORTUNITY, OR GOODWILL ARISING FROM USE OF THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, CAT CHAMPIONS' AGGREGATE LIABILITY ARISING FROM THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO CAT CHAMPIONS DURING THE SIX MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE DISCLAIMED OR LIMITED, INCLUDING LIABILITY TO THE EXTENT A LIMITATION IS PROHIBITED BY APPLICABLE LAW.

24. Indemnification

To the fullest extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, and reasonable costs arising from your intentional misuse of the Service, unlawful conduct, infringement of another person's rights, fraud, or material violation of these Terms.

This section does not require a consumer to indemnify Cat Champions for Cat Champions' own unlawful conduct where such an obligation would be prohibited by law.

25. Suspension and Termination of Service

You may stop using Cat Champions at any time.

Cat Champions may restrict, suspend, or terminate your license to some or all of the Service for the reasons described in these Terms.

To the fullest extent permitted by applicable law, Cat Champions may also refuse or discontinue service to a user for another lawful, non-discriminatory reason when reasonably necessary to protect the Service, its community, its personnel, or its operation.

Termination of an account ends the license granted under these Terms.

Sections that by their nature should survive termination—including provisions concerning intellectual property, Virtual Content ownership, payment reversals, disclaimers, limitations of liability, disputes, and enforcement relating to prior conduct—survive termination.

26. Changes to These Terms

Cat Champions may update these Terms as the Service, law, security requirements, or business practices change.

When a material change requires renewed agreement, Cat Champions may require you to affirmatively accept the new version before continuing to use the Service.

A material amendment will apply prospectively from its effective date except where applicable law permits otherwise.

Cat Champions will maintain a version or effective date identifying the Terms presented for acceptance.

27. Governing Law

Except to the extent applicable law provides otherwise, these Terms and disputes arising from them are governed by the laws of the State of California, without regard to conflict-of-law principles.

Mandatory consumer rights provided by applicable law are not waived merely because these Terms select California law.

28. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS LEGAL RIGHTS, INCLUDING THE RIGHT TO HAVE CERTAIN DISPUTES DECIDED BY A JUDGE OR JURY.

Before commencing formal proceedings, you and Cat Champions agree to make a good-faith attempt to resolve a dispute informally. A notice of dispute should describe the account involved, the nature of the dispute, and the relief requested and should be sent to support@catchampions.com. Either party may proceed after 30 days if the dispute has not been resolved.

Except for disputes eligible for small claims court and claims or remedies that applicable law does not permit to be subjected to individual arbitration, disputes arising from or relating to these Terms or the Service will be resolved by binding individual arbitration under the Federal Arbitration Act.

The arbitration will be conducted in a reasonably convenient manner, including remotely where appropriate and permitted, unless the parties agree otherwise or applicable law requires another procedure.

Arbitration fees and costs will be allocated as required by applicable law. Cat Champions will pay any arbitration fees or costs that applicable law requires Cat Champions to pay in order to enforce this arbitration agreement.

The arbitrator may award any individualized remedy that a court could award.

YOU AND CAT CHAMPIONS AGREE THAT COVERED CLAIMS WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING, TO THE EXTENT THIS WAIVER IS PERMITTED BY LAW.

Nothing in this section waives a right to seek public injunctive relief or another remedy that applicable law prohibits the parties from waiving. Where such a claim cannot lawfully be arbitrated on an individual basis, that claim may proceed in a court of competent jurisdiction while arbitrable claims may be handled as permitted by applicable law.

Either party may elect to bring an eligible individual claim in small claims court instead of arbitration.

You may opt out of this arbitration agreement by sending written notice to support@catchampions.com within 30 days after first accepting a version of these Terms containing this arbitration provision. The notice must clearly state that you are opting out of arbitration and identify the Cat Champions account to which the opt-out applies.

If the arbitration provisions are held inapplicable to a particular dispute, then, except where applicable consumer law requires otherwise, the parties consent to the exclusive jurisdiction of the state and federal courts located in the California county in which Cat Champions' Operator maintains its principal place of business.

29. Severability

If a provision of these Terms is held unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where appropriate, and the remaining provisions will remain in effect unless applicable law requires otherwise.

30. No Waiver

Failure by Cat Champions to enforce a provision on one occasion does not waive the right to enforce that provision or another provision later.

Past tolerance of particular conduct does not create permission to continue that conduct.

31. Entire Agreement

These Terms, together with policies and transaction terms expressly incorporated into them, constitute the agreement between you and Cat Champions concerning the Service and supersede prior terms concerning the same subject matter.
